1. Acceptance of Terms

By accessing or using Smutfinder, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our platform.

2. Eligibility

Smutfinder is intended for individuals who are 18 years of age or older. By using Smutfinder, you represent and warrant that you meet this age requirement.

3. User Accounts

• Registration: To access certain features, you may be required to create an account. You agree to provide accurate and complete information during registration and to keep your information up to date.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use of your account.

4. User-Generated Content (UGC)

• Ownership: You retain ownership of the content you create and upload to Smutfinder.
• License: By uploading content, you grant Smutfinder a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the platform for the purpose of operating, marketing, and improving our services.
• Content Restrictions: You may not upload, post, or distribute content that:
  • Violates any applicable laws or regulations
  • Infringes on the intellectual property or privacy rights of others
  • Contains harmful, abusive, defamatory, or obscene material

5. Prohibited Activities

You agree not to:

• Use Smutfinder for any illegal purpose
• Share, distribute, or reproduce content outside of Smutfinder without explicit permission
• Upload viruses or malicious code
• Attempt to gain unauthorized access to other users' accounts or Smutfinder's systems

6. Payments and Transactions

6.1 Digital Currency and Credits

• Digital Currency: Smutfinder uses a digital currency system that may be referred to as “credits” or “coins” throughout the platform. These credits are used to access premium features and content.
• All Sales Final: All purchases of credits, coins, or top-up packs are final and non-refundable. Once purchased, credits cannot be returned, exchanged, or refunded under any circumstances.
• No Cash Value: Credits and coins have no monetary value outside of the Smutfinder platform. They cannot be transferred, sold, or exchanged for real currency or any other form of value.
• Non-Transferable: Credits cannot be transferred between user accounts or converted back into real currency. They are tied exclusively to the purchasing account.
• Top-Up Packs: Additional credits may be purchased through top-up packs to supplement your account balance as needed.

6.2 Subscription Services

• Subscription Tiers: Smutfinder offers subscription services including “Pro” and “Premium” tiers, each providing different levels of access to platform features.
• Cancellation: You may cancel your subscription at any time through the Stripe Billing Portal via “Manage Subscription” or by contacting customer support.
• No Partial Refunds: There are no refunds for partial subscription periods. If you cancel your subscription, you will not receive a prorated refund for the unused portion of your billing period.
• Service Continuation: Upon cancellation, your subscription benefits will continue until the end of your current billing period, after which your account will revert to the free tier.
• Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

6.3 Technical Service Issues

• No Credits for Technical Issues: Technical problems, service interruptions, maintenance downtime, or other technical difficulties do not qualify users for credit refunds, additional credits, or service extensions.
• Service Availability: While we strive to maintain consistent service availability, Smutfinder is provided “as available” and we do not guarantee uninterrupted access.
• Maintenance: We reserve the right to perform scheduled and emergency maintenance that may temporarily affect service availability.

6.4 Payment Processing

All payments made through Smutfinder are processed securely through third-party payment processors. You agree to provide accurate billing information and authorize us to charge your payment method for all fees incurred. You are responsible for any applicable taxes, fees, or charges imposed by your financial institution.

7. Termination and Account Management

7.1 Account Termination Rights

• Our Termination Rights: We reserve the right to suspend, restrict, or terminate your account immediately and without prior notice if you violate these terms, engage in fraudulent, abusive, or harmful activities, or for any other reason at our sole discretion.
• Your Termination Rights: You may terminate your account at any time by contacting us at hello@smutfinder.com or through your account settings.
• Effect of Termination: Upon termination, your access to paid features will cease immediately, and any unused credits or subscription time will be forfeited without refund.

7.2 Investigation and Fraud Prevention

• Transaction Investigation: We reserve the right to investigate any suspicious, unauthorized, or potentially fraudulent transactions, including but not limited to unusual payment patterns, chargebacks, or disputed charges.
• Account Suspension During Investigation: We may temporarily suspend your account and freeze any credits or subscription benefits while investigating potential violations or fraudulent activity.
• Chargeback and Dispute Handling: We request that you contact our support team before initiating a payment dispute. Failure to do so may result in account restrictions, termination, or delayed resolution.

7.3 Prohibited Payment Activities

The following activities may result in immediate account termination:

• Using stolen, fraudulent, or unauthorized payment methods
• Attempting to circumvent payment systems or exploit pricing errors
• Sharing account credentials to avoid individual payment obligations
• Engaging in credit manipulation or attempting to generate credits through unauthorized means
• Violating any applicable laws related to digital payments or online transactions

8. Disclaimers and Limitation of Liability

Smutfinder is provided “as is” and “as available” without warranties of any kind, either express or implied. We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform.

9. Indemnification

You agree to indemnify and hold harmless Smutfinder, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the platform, your content, or your violation of these terms.

10. Governing Law

These terms are governed by the laws of the State of Nevada, without regard to its conflict of law principles. Any disputes arising under or in connection with these terms will be resolved exclusively in the state or federal courts located in Nevada.

11. Changes to Terms

We may modify these Terms of Service from time to time. We will notify you of any changes by updating the effective date and posting the new terms on Smutfinder. Your continued use of the platform after changes are posted constitutes your acceptance of the revised terms.
